Terms of Sale – Hector Photo

1. Seller identity
The Hector Photo service is published and operated by:

2. Purpose
Hector Photo allows users to order prints of photographs sent via WhatsApp and have them delivered to the address provided at checkout.
3. Contract formation
Sending photographs does not constitute an order.
An order is considered final after:
- validation of the order contents;
- provision of delivery information;
- full payment of the order.
4. Prices
Prices shown are in euros, including all taxes.
Delivery fees are displayed before payment validation.
The applicable price is the one shown at the time of order validation.
5. Payment
Payment is made via Stripe.
Bank card data is processed directly by the payment provider and is never accessible to Hector Photo.
6. Production and shipping
Photographs are printed after payment validation.
Orders are generally shipped within 48 business hours, except in exceptional circumstances.
7. Delivery
Hector offers delivery to mainland France, Corsica and abroad.
In mainland France and Corsica, allow 3 to 5 business days after payment confirmation.
For international deliveries, times and shipping costs are shared on WhatsApp before the order is confirmed.
The customer is solely responsible for the accuracy of the delivery information provided.
Costs related to an incorrect or incomplete address may be charged to the customer.
When several delivery methods are offered, the customer freely chooses the desired method.
8. Untracked mail
When the customer chooses an untracked delivery method, Hector Photo cannot guarantee the location of the shipment after dispatch.
Any request for reshipment or refund will be examined on a case-by-case basis.
9. Lost parcels
In the event of a confirmed loss of the parcel by the carrier, Hector Photo may, at its discretion:
- reprint the order;
- or issue a refund.
10. Quality of submitted files
The customer remains solely responsible for the choice of photographs sent.
Hector Photo does not systematically check the quality, resolution, sharpness, brightness or content of submitted photographs.
Hector Photo cannot be held liable when print quality is affected by the characteristics of the file provided.
11. Automatic cropping
To adapt the photograph to the selected format, automatic cropping may be applied.
Hector Photo does not guarantee that all elements present in the photograph will be preserved when the aspect ratio of the print differs from that of the submitted file.
12. Colour rendering
Colour rendering may vary between the customer's screen and the printed material.
These differences do not constitute a product defect.
13. Personalised products and right of withdrawal
Products made from photographs submitted by the customer are personalised products.
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised.
14. Intellectual property
The customer warrants that they hold all necessary rights to reproduce the submitted content.
The customer also warrants that they hold the necessary authorisations regarding people depicted in the photographs.
The customer remains solely responsible for the content submitted.
15. Prohibited content
Hector Photo reserves the right to refuse any order containing content that is:
- illegal;
- violent;
- hateful;
- pornographic;
- infringing third-party rights;
- or contrary to applicable regulations.
16. Administrative documents
Hector Photo is not intended for printing administrative, banking or contractual documents.
The customer remains solely responsible for the documents submitted.
17. Claims
Any claim must be sent to contact@hector.now within 14 days of receiving the order.
18. Limitation of liability
Hector Photo's liability is limited to the amount of the order concerned, unless otherwise required by law.
19. Force majeure
Hector Photo cannot be held liable for any delay or inability to perform resulting from a force majeure event.
20. Governing law
These terms of sale are governed by French law.
In the event of a dispute, the parties will seek an amicable solution before any legal action.
